Student Data Policy

1. Overview of Student Data Collection

When an Educational Institution customer makes our NextPitch Services available to students for an educational purpose, NextPitch may process personal information that is directly related to an identifiable student, which is:

(i) Provided to NextPitch by an Educational Institution, or
(ii) Collected or generated by NextPitch during the provision of Services to the Educational Institution (“Student Data”).

Student Data may include information defined as:

• “Educational records” under the Family Educational Rights and Privacy Act (FERPA),

• “Covered information” under California’s Student Online Personal Data Protection Act (SOPIPA), or

• Other student data privacy laws that protect student information.

2. Protection and Use of Student Data

We consider Student Data to be confidential and do not use Student Data for any purpose other than to provide our Services on the Educational Institution’s behalf, in accordance with contractual agreements with the Educational Institution.

To help Educational Institutions meet their student data privacy obligations, we have implemented additional controls and procedures for Educational Institutions when they enter into a contract with NextPitch to make our Services available for educational purposes, such as our Student Data Privacy Addendum.

As between NextPitch and the Educational Institution, Student Data is owned and controlled by the Educational Institution.

Our collection and use of Student Data is governed by:

• Contracts with Educational Institutions

• Applicable privacy laws

• For example, we provide our Services to Educational Institutions as a “School Official” under FERPA, and we work with Educational Institutions to protect personal data from the Student’s educational record, as required by FERPA.

 

3. Commitment to Data Privacy and Security

We collect, maintain, use, and share Student Data only for an authorized educational purpose and as described in our agreement with the Educational Institution, or as directed by the Educational Institution or the Student’s parent or legal guardian (each, a “Parent”).

We adhere to the following strict privacy commitments:

​

• No Targeted Advertising – We do not use or disclose Student Data for targeted advertising purposes. No personalized advertising (ads based on a user’s personal information) is used or displayed in NextPitch’s products.

• No Unauthorized Sharing – We do not share Student Data with third-party advertisers or use it to create profiles for advertising purposes.

• No Unauthorized Student Profiling – We do not build a personal profile of a Student beyond what is necessary to support an educational purpose.

• Comprehensive Data Security Program – We maintain a robust security program designed to protect Student Data.

• Transparency – We will clearly disclose our data policies and practices to users.

• No Sale of Student Data – We will never sell Student Data, unless the sale is part of a corporate transaction (e.g., merger, acquisition, bankruptcy, or other sale of assets). In such cases, we will require the new owner to continue honoring this Student Data Policy or we will provide the Educational Institution with an option to delete Student Data before the transfer occurs.

• No Material Policy Changes Without Notice – We will not make material changes to our Student Data Policy or contractual agreements regarding Student Data collection and use without first providing notice to the Educational Institution and offering a choice before using Student Data in a materially different manner than originally disclosed.

4. How We Share and Disclose Student Data

We only disclose Student Data as needed to provide our Services on behalf of specific Educational Institutions, in accordance with:

 

Our contractual agreements with the Educational Institutions, or
With consent from the Educational Institution or Parent.
For example, Student Data and account usage data may be disclosed to:

Authorized users acting on behalf of the Educational Institution, such as:
The Student’s teacher
The Student’s school administrator
Trusted service providers who need access to this information on our behalf (subject to strict contractual protections).
Legal and compliance purposes, as described in our Privacy Policy.

5. Use of De-Identified Data

NextPitch may generate, use, and disclose de-identified information to:

Support adaptive learning or customized student learning.
Recommend educational content or services related to Educational Institution purposes.

Conduct research and improve our Services.
Demonstrate the effectiveness of our Services.
Develop and improve other educational technologies, where permitted by law.

 

Definition of De-Identified Data:
De-identified information is data where all personally identifiable information has been removed or obscured so that it cannot reasonably identify an individual.

6. Retention and Deletion of Student Data
 

We do not knowingly retain Student Data beyond the time required to support an educational purpose, unless authorized by the Educational Institution.

Educational Institution’s Role in Student Data Management

Educational Institutions are responsible for:

​

• Maintaining current student rosters

• Managing Student Data that is no longer needed for an educational purpose

• Submitting deletion requests when Student Data is no longer required
   

Automatic Deletion or De-Identification: Even without specific deletion instructions, NextPitch may delete or de-identify data after a period of user inactivity, per our standard data retention policies.

• Access Student Data

• Delete Student Data

• Close an account
